Surveillance & Recording Compliance Policy

1. PURPOSE
This Surveillance & Recording Compliance Policy (“Policy”) establishes the legal requirements, user responsibilities, and compliance standards governing the purchase, installation, operation, and use of surveillance and recording equipment sold or distributed by Blackwell Group Inc. (“BGI,” “Company,” “we,” “our,” or “us”).
BGI distributes equipment capable of audio and/or video recording that may be regulated under federal, state, local, and international laws.
2. NO LEGAL ADVICE & NO WARRANTY OF COMPLIANCE
BGI does not provide legal advice and makes no representations or warranties regarding the legality of any product or use case in any jurisdiction.
By purchasing or using BGI products, you acknowledge that:
- Laws governing surveillance and recording vary by jurisdiction
- Legal requirements may change without notice
- You are solely responsible for determining lawful use
3. LEGAL COMPLIANCE REQUIREMENT
You agree that you will:
- Use all surveillance and recording equipment strictly in accordance with applicable laws
- Comply with all privacy, consent, and data protection regulations
- Avoid any use that infringes upon civil rights or reasonable expectations of privacy
All legal responsibility rests solely with the purchaser and end user.
4. AUDIO RECORDING & CONSENT LAWS
Audio recording is subject to jurisdiction-specific consent requirements, including:
- One-party consent laws
- All-party (two-party) consent laws
You are solely responsible for:
- Determining applicable consent requirements
- Obtaining all necessary permissions prior to recording
- Complying with all laws governing audio interception and recording
Unauthorized recording may result in civil and/or criminal liability.
5. VIDEO SURVEILLANCE REQUIREMENTS
Users must ensure that video surveillance:
- Is conducted only in legally permissible locations
- Does not violate reasonable expectations of privacy
- Complies with all applicable residential, commercial, and public-space regulations
Surveillance is strictly prohibited in areas where privacy is expected, including but not limited to:
- Bathrooms and restrooms
- Changing rooms or locker rooms
- Private living areas without lawful consent
6. BUSINESS, WORKPLACE & INSTITUTIONAL USE
Organizations deploying surveillance equipment are solely responsible for:
- Compliance with employment, labor, and workplace privacy laws
- Providing legally required notice to employees, tenants, or occupants
- Establishing internal policies governing surveillance use, access, and oversight
- Ensuring lawful monitoring practices
BGI assumes no responsibility for organizational compliance or policy enforcement.
7. DATA COLLECTION, STORAGE & SECURITY
Users are solely responsible for:
- Managing all recorded data in compliance with applicable privacy and data protection laws
- Securing recordings against unauthorized access, disclosure, or misuse
- Establishing retention, access control, and deletion policies
BGI:
- Does not store, access, monitor, or manage user-generated data
- Has no control over how recordings are collected, stored, or used
8. PROHIBITED USES
Products sold by BGI may not be used for:
- Unlawful surveillance or monitoring
- Harassment, stalking, intimidation, or coercion
- Violations of privacy rights or civil liberties
- Any activity prohibited by applicable law
BGI reserves the right to deny service or restrict transactions where misuse is suspected.
9. ASSUMPTION OF RISK
By purchasing or using surveillance or recording equipment, you:
- Acknowledge the legal and regulatory risks associated with such use
- Accept full responsibility for compliance with all applicable laws
- Assume all risks related to recording, monitoring, and data handling
10. LIMITATION OF LIABILITY
To the fullest extent permitted by law, BGI shall not be liable for:
- Unlawful or improper use of surveillance equipment
- Violations of privacy, consent, or data protection laws
- Regulatory penalties, fines, or enforcement actions
- Civil or criminal claims arising from surveillance activities
- Damages resulting from recording or monitoring practices
All equipment is used at the sole risk of the purchaser and end user.
11. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless BGI, its officers, employees, and affiliates from any claims, damages, liabilities, or expenses arising from:
- Unlawful surveillance or recording
- Failure to comply with applicable laws or regulations
- Misuse or improper deployment of equipment
- Violations of privacy, consent, or civil rights
12. NO MONITORING, CONTROL, OR OVERSIGHT BY BGI
BGI does not:
- Monitor user activity
- Access or store recordings
- Provide oversight or supervision of surveillance operations
All equipment is sold as standalone products, and all use is exclusively controlled by the purchaser.
13. REGULATORY CHANGES
Laws governing surveillance and recording may change.
BGI is not responsible for:
- Changes in legal requirements after purchase
- Customer inability to use products due to regulatory updates
- Ongoing compliance obligations
14. COMPLIANCE-FIRST OPERATING STANDARD
BGI operates under a compliance-first framework.
We reserve the right to:
- Refuse or cancel orders
- Deny service
- Restrict transactions
where legal, regulatory, or misuse risks are identified.
15. POLICY UPDATES
BGI reserves the right to modify or update this Policy at any time.
Changes become effective immediately upon posting.
